LEGAL FEES AND PRICES

Bress Law Firm, PLLC. is located in Aventura, Florida, cordially serving clients throughout Miami and Broward. Bress Law Firm is the legal practice of Michael N. Bress, attorney at law, a boutique law firm providing premium legal services at reasonable prices. Our primary areas of law are Wills, Trusts, and Estates, Business Law, and Landlord and Tenant Law, including other legal services involving Contracts and Property Law.

Our flat fee and hourly prices are listed below. Flat fee services include legal consultation and advice, along with whatever is necessary for us to deliver top quality legal services for all of our clients.

Non-typical, complex, or extensive legal services may be billed on an hourly or case-by-case basis. Ongoing disputes that involve extensive negotiation, litigation, research, or complex planning are usually billed hourly. Our hourly fees are $275 an hour. Combined flat-fee legal services and causes of action that overlap are priced at a discount. We can usually quote you a fee or rate after a review of your legal matter.

Unless otherwise indicated, clients bear their own costs such as filing fees, recording costs, and court costs.

FEE STRUCTURE FOR OUR AREAS OF LAW:

WILLS, TRUSTS, AND ESTATES

Estate Planning: $275hr for non-flat fee or extensive estate planning services not reasonably anticipated or necessary as part of a flat-fee legal-service.

Last Will and Testament Package: Individual: $750. Couple; Separate Wills: $1,100.

Includes: Legal consultation and advice, Last Will and Testament, Living Will Package, Financial Power of Attorney, and proper Execution Ceremony (i.e., formal signing, witnessing, and notarization of estate documents). *Mutual wills are discouraged as problematic; a trust alternative will usually be recommended.

Living Will Package: $450.

Includes: Legal consultation and advice, Advanced Directives, Healthcare Powers of Attorney, HIPPA Release, Financial Power of Attorney, and proper Execution Ceremony (i.e., formal signing, witnessing, and notarization of estate documents).

Revocable Living Trust Package: Individual: $1,800. Couple; Joint Trust: $2,250. Couple; Separate Trusts: $2,700.

Includes: Legal consultation and advice, Revocable Living Trust (standard provisions), Healthcare Powers of Attorney, HIPP Release, Financial Powers of Attorney, Deed of Transfer, and proper Execution Ceremony (i.e., formal signing, witnessing, and notarization of estate documents).

Last Will and Testament: $575.

Revocable Living Trust: Individual: $1,500. Couple; Joint Trust: $1875. Couple; Separate Trusts: $2,250.

Power of Attorney (General, Special, Durable): $225.

Healthcare Power of Attorney: $225.

Advanced Medical Directives (Living Will): $225.

Deed (Quit Claim Deed, General Warranty Deed, Special Warranty Deed, or Gift Deed): $325. + Recording Fees. *Title Search: add $175 + Client Costs.

Lady Bird Deed: $350. + Recording Fees.

*Special trust provisions, or equivalent provisions in pour over wills, such as spendthrift, credit shelter, special needs, or other extensive provisions, add $325 per provision.

BUSINESS LAW

Contract Drafting / Review: Contract Drafting: $105pg. Minimum: $575. Contract Review: $45pg. Minimum: $325. *Charges do not apply to attachments such as statutes or certain disclosures that do not require drafting or thorough review.

Legal Notices / Demand Letters: Depends on type. Case by Case Basis.

LLC Formation Package: Florida 1-Member LLC & Operating Agreement: $725 + Filing Fees; Florida Multi-Member LLC & Operating Agreement: $1,050 + Filing Fees (for up to 3 members, otherwise case by case basis).

Includes: Legal consultation and advice, Articles of Organization, Operating Agreement, and Incorporation + filing of documents.

Corporation Formation Package: Incorporation (only): $600+. Full Corporate Package: $1,300+.

Includes: Legal consultation and advice, Articles of Incorporation, Bylaws, Shareholder Agreement, and Incorporation + filing of documents. *Complex or extensive incorporations are billed on a case-by-case basis.

LLC Formation: 1-Member LLC: $400 + Filing Fees. Multi-Member LLC: $625 (for up to 3 members, otherwise case by case basis).

LLC Operating Agreement: 1-Member Agreement: $525. Multi-Member Agreement: $725 (for up to 3 members, otherwise case by case basis).

Corporate Bylaws / Shareholder’s Agreement: $600+ (case by case basis for complex or extensive bylaws). For Both: $900.

Civil Business Litigation: County Court: $275hr. Circuit Court: Case by case basis. *Requires 5K-15K retainer up-front, additional 5K once escrow falls below $1,500. Client bears own costs.

REAL ESTATE TRANSACTIONS

Real Estate Transaction (Residential / Commercial): $275hr.

Including: Legal consultation and advice¸ Drafting and review of contracts and documents, Negotiation and correspondence with parties, Resolution of issues (such as mortgage issues, title issues, inspection issues, damage disputes, and tenant issues), proper Execution of Documents (i.e., signing, witnessing, and notarization), and Representation at closing.

Real Estate Closing (Residential / Commercial): Residential Closing; $750; Commercial Closing $950+ (case by case basis). *Legal services not reasonably necessary for the closing are billed at our hourly rate of $275hr.

LANDLORD AND TENANT LAW

Residential Eviction; Unpaid Rent: Uncontested: $795. Contested: after 1st hearing, $275 for each additional court appearance. Monetary Damages: add 15% of the amount in controversy.

Residential Eviction; Termination of Lease: $1,500 (for 8hrs of legal work, then $275hr). Monetary Damages: add 15% of the amount in controversy.

Commercial Eviction; Unpaid Rent: Uncontested: $1,500+ (case by case basis). Contested: after 1st hearing, add an additional $275 for each additional court or mediation appearance. Monetary Damages: add 15% of the amount in controversy.

Commercial Eviction Termination: $1,500 or hourly (case by case basis). Monetary Damages: add 15% of the amount in controversy.

Security Deposit Litigation: $1K-$4K: $895; 4K-8K: $1,100; 8K+: 20% of the amount in controversy.

Ejectment Litigation: $275hr.

Legal Notices: $225-$325.

Demand Letters: Starting at $225.

*State of Florida only.
